...
Of interest to descendents of William and Eleanor (Hudson) Burden are affidavits taken at Sparta, Tennessee, of Hayes Arnold, David Moore, John Waller, Pleasant W. Waller, and A. S. Rodgers.  These affidavits were taken in connection with the Peck vs.  Borden, Borden vs.  Peck case regarding the estate of "Fairfax Ben" Borden, who died in Frederick County, Virginia in 1743.  The estate was still being fought over on January 23, 1878, when these affidavits were taken.

---Affidavit of Hayes Arnold (abstract)
He knew William Burden who died 3 miles from Sparta three or four years ago, and also knew his brothers, Elijah and Esquire Burden.  In 1878, all of them were dead.  He also knew old William Burden, Sr., who lived on the John Cunningham Farm, as long ago as 50 years.  He knew Malinda Burden, daughter of Elijah Burden, deceased.  He knew Martha Ann and Abner Smith.  Martha Ann was the daughter of Esquire Burden.  William Burden, Jr. died without heirs.  William Burden, Sr., Elijah, Esquire and William, Jr. are all dead.

---Affidavit of Anderson Rodgers (abstract)
He also knew all of the persons mentioned in Hayes Arnold's deposition and added that William Burden, Jr., now dead, said his father, William, Sr., was a native of Virginia.

---Affidavit of John Waller (abstract)
He said that he was raised within less than a mile of Will Burden, Sr., home place and stated that William Burden, Sr., died in Arkansas.  He added that William Burden, Sr., went to Virginia about 50 years ago.

---Affidavit of Pleasant W. Waller (abstract)
He agreed with all statements except that of William Burden, Sr. going to Virginia.

---Affidavit of David Moore (abstract)
He stated that he knew Malinda Burden (daughter of Elijah) and Martha Ann Burden (daughter of Esquire).  He also knew William Burden, Sr., and that they came from Virginia, and that William Burden, Jr., bragged about the fortune from Virginia."
